Overview

Jack Ong’anya is the Managing Partner and a co-founder of Ong’anya Ombo Advocates LLP dba O’Bang Law, where he heads the Litigation & ADR Department. Widely respected for his legal prowess, he possesses extensive experience in civil and criminal law with a strong emphasis on dispute resolution. Ong’anya is described as a captivating presence in the courtroom and has perfected the art of oral representation and dedicated appearance on Clients’ matters before the respective Courts. At one point during the proceedings, a Judicial Officer stated, “Mr. Ong’anya has never missed his Court date and is always punctual.

Ong’anya has carved out a niche in legal practice and is regularly engaged in arbitration, probate and administration, employment disputes, constitutional disputes, insurance disputes, criminal and anti-corruption cases, and election disputes, among other areas.  He has been engaged in very important and precedent setting legal disputes. Notably he has acted in the following high profile cases:

  1. Successfully represented Red Dot Distribution EPZ Limited in 2022 to recover VAT and Drawback Duty of about KES. 12 million paid in 2009 or thereabouts to Kenya Revenue Authority (KRA), which, KRA had declined to refund Red Dot Distribution because of elapsed time: HCCOMMPET NO. 005 OF 2022.
  2. Successfully represented the Directors of Premier Flower Mills Limited on a Show Cause case initiated against the Directors to explain why a decretal sum of KES. 22,666,420 should not be paid by the directors in person. He successfully presented to the Court why the Directors had not disobeyed the Court Orders as they do not have direct control of the assets of the company after crystallization of a floating charge and all shares were paid up: Nairobi ELRC NO. E271 of 2019.
  3. Successfully represented The New Democrats Party (TND) in compelling its duly elected members of Parliament and County Assembly to remit part of their salaries to the party.
  4. Represented a former Student of Machakos University against the said University for using her image in brochures and billboards in marketing the institution. He assisted the court in developing a formula to be used in determining the damages.
  5. Successfully represented contractors procured by KPLC to offer various services and who had been charged at the Anti-Corruption Court with the offence of fraudulently obtaining public property. It was alleged that they were unprocedurally prequalified, hence any payment they earned amounted to fraudulent obtaining of public property. They were all acquitted.
  6. Successfully represented an employee of Nairobi County who had been charged with the offence of stealing a crucial county file (Nairobi JR 433 of 2009 Iris Properties -vs- The City Council of Nairobi). This was a crucial file that had all payment details worth KES. 129,000,000/=. Our client was acquitted.
  7. Successfully petitioned the Employment and Labour Relations court on the interpretation of the time limit for members of Parastatal bodies appointed by the Head of State, first as members and secondly as chairpersons of the said parastatals. Nairobi ELRC PET/E102/2023.

Ong’anya also appears before the administrative and quasi-judicial tribunals such as the Business Premises Tribunal, Cooperative Tribunal and Tax Tribunal.
