Freada Kinda is a legal professional with experience in litigation support, legal research, and regulatory compliance. She works within a dispute resolution and regulatory practice, supporting matters before courts and statutory tribunals, and assisting in the preparation of pleadings, submissions, and advisory opinions. - Successfully part of the team that represented Kilimall International Limited in employment litigation arising from Mavoko CMCC ELRC No. 16 of 2020. The Court, following fresh proceedings before ELRC No. 663 of 2022, agreed with our advanced submissions, finding that the termination was lawful and procedurally fair, dismissing the Claimant’s substantive claims, and limiting the Claimant’s entitlement to KES 150,000 in lieu of notice.
- Successfully part of the team that acted for the Petitioner in Shadrack Murithi v Prof. Oyuko O. Mbeche & 4 Others (ELRC Petition No. E102 of 2023 (2024) where the Court agreed with the arguments advanced, affirming that public and state officers, regardless of designation, remain servants of the people and are subject to constitutional and statutory obligations.
- Successfully part of the team that acted in Caroline Wambui Ndirangu v Nation Media Group Limited & Joseph Kanyi (HCCC E149 of 2020 (2024), a matter before the High Court, where the Court adopted our position that although the Data Protection Act, 2019 had been assented to, the absence of an operational regulatory framework in 2020 rendered the complaint mechanism before the Office of the Data Protection Commissioner unavailable at the material time, and accordingly affirmed its jurisdiction to hear our Client’s claim on breach of image and privacy rights.
- Successfully part of the team that acted in Allan Maina Kuria v The Honourable Attorney General (MCCC No. 423 of 2022, Kiambu Law Courts), a claim for unlawful confinement and malicious prosecution, where the Court found that the criminal proceedings had been instituted without reasonable and probable cause and were actuated by malice, and entered judgment in favour of the Plaintiff, awarding KES 500,000 in general damages together with costs and interest.
